A New York judge has upheld the city’s dismantling of the Occupy Wall Street encampment, saying that the protesters’ first amendment rights don’t entitle them to camp out indefinitely in the plaza.
State judge Michael Stallman on Tuesday denied a motion by the demonstrators seeking to be allowed back into the park with their tents and sleeping bags.
Police cleared out the protesters in a nighttime sweep early Tuesday. The judge upheld the city’s effective eviction of the protesters after an emergency appeal by the National Lawyers Guild.
I wonder if there are plans to appeal.
BTW, I’m watching a livestream from Zuccotti Park — here — and the “moderator” just said a text message went out asking “everyone” to come to Zuccotti Park right now so we’ll see what happens next.
Here are the details of the court’s ruling. It could be worse. The protesters can re-enter the park but they can’t construct “semi-permanent structures” or erect tents.

Congress wants to keep pizza and french fries on school lunch lines, fighting back against an Obama administration proposal to make school lunches healthier.
The final version of a spending bill released late Monday would unravel school lunch standards the Agriculture Department proposed earlier this year, which included limiting the use of potatoes on the lunch line and delaying limits on sodium and delaying a requirement to boost whole grains.
The bill also would allow tomato paste on pizzas to be counted as a vegetable, as it is now. USDA had wanted to prevent that.
Food companies that produce frozen pizzas for schools, the salt industry and potato growers requested the changes, and some conservatives in Congress say the federal government shouldn’t be telling children what to eat.

This would be our Tweet of the Day, regarding New York Mayor Michael Mubarak Bloomberg’s decision to ignore an injunction issued this morning ordering that the protesters in Zuccotti Park be permitted to return (after they were thrown out overnight). I.e., Bloomberg and the police are currently in contempt of court but hey, why should they care?
There’s a stand off in Zuccotti Park this morning.
The police evicted the protesters over night. Since then, a judge in Manhattan issued a restraining order against the POLICE and told the protesters they can go back to the park, but the police are disobeying the court’s order.
We’re in a frightening place when the people charged with enforcing the law are ignoring the law. Who are the anarchists now?
