Obama: It’s Okay to Kill Americans Without Due Process

Now I know why Barack Obama shot that gun. He wants to kill our right to due process:

A confidential Justice Department memo concludes that the U.S. government can order the killing of American citizens if they are believed to be “senior operational leaders” of al-Qaida or “an associated force” — even if there is no intelligence indicating they are engaged in an active plot to attack the U.S.
Last I knew, every American is entitled to and guaranteed a trial by a jury of his or her peers before he or she is sentenced to anything, much less death.
Now we have the “liberal” Constitutional lawyer Barack Obama’s Justice Department obliterating that for what will probably be forever.
Blows my mind.

Somehow this post reminds me of two songs: “Young Lawyers in Love” and Rita Coolidge singing, “Words are All I Have.”
Words are a lawyer’s building blocks. An ordinary word may have extraordinary meaning in a particular legal encounter. “Neglect” in conversation means a mere oversight. As a term of legal art it embodies 3 or 4 discrete, critical concepts of remarkable importance.
The DOJ White Paper your post identifies distinguishes between “belligerent” and “criminal” in a very legally significant context: war. An act or association that may be entirely benign or merely criminal during peace, may during war be the object of appropriate, immediate, lawful deadly force of arms.
Thus the White Paper premises & justifies lethal force against all persons who are the “enemy” because of a “congressionally authorized armed conflict,” that is, a “war.” But for the existence of “war” there could be no “enemy,” no belligerents, perhaps only some criminals or others we merely dislike. There could be no use of deadly force except with due process of law. There could be no regrettable “collateral civilian casualties,” only murder victims.
As long as this state of war continues the President will have war powers which may, and arguably must, be faithfully executed. It’s time, perhaps long so, to end this state of war, to withdraw this legislated authorization, to declare a state of peace, and to end this practice of summary execution of “enemy combatants,” be they US citizens or otherwise.
Keep a lookout for the writings and speaking of Harold Koh. He was the DOJ’s lawyer, and a good one, who recognized these legalities, used them and has now publicly called for them to be ended.
