Gay Flag - Best OneA federal judge has struck down Utah’s same-sex marriage ban, saying it is unconstitutional.

U.S. District Judge Robert J. Shelby issued a 53-page ruling Friday saying Utah’s law passed by voters in 2004 violates gay and lesbian couples’ rights to due process and equal protection under the 14th Amendment.

Shelby says the state failed to show that allowing same-sex marriages would affect opposite-sex marriages in any way, and the state’s unsupported fears and speculations are insufficient to justify deny allowing same-sex marriages.

Within hours, Salt Lake County District Attorney Sim Gill confirmed that, in light of the ruling, he saw no reason to prohibit Salt Lake County Clerk Sherrie Swensen from issuing marriage licenses to same-sex couples.

    Three comments, interrelated: (1) Right decision. (2) Ultimately the same rationale will lead to Utah de-criminalization of polygamy, i.e., It will allow one lawful spousal unit to cohabit with other “family members” while not giving each legal status of marriage. (3) Duck Man Father was not sacked or disciplined for his comments about gays. At least 1/3 of Americans and 90% of Duck Dynasty audience agrees with him, so I can’t imagine A&E gives a hoot. He should have been disciplined regarding his intentional misstatement of racial relations in the South in the 60’s. Personally, I think it’s a shameful & utterly cynical publicity stunt.

    You’re the second person I’ve heard say they think this is all a publicity stunt. If so, ugh, what a depraved human being. But you’re right about what he said about race relations in the 60s. He issued a statement after all this blew up, blaming having been a child of the 50s/60s for his feelings about gays but what he said about African Americans leads one to believe he doesn’t remember that era at all.
